Terms of Service

These Terms of Service (“Terms”) govern your use of the Bawte platform, including the consumer application at app.bawte.com and related services (the “Services”), operated by Bawte, Inc. (“Bawte,” “we,” “us,” or “our”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Eligibility

You must be at least 13 years of age to use our Services. If you are between 13 and 18 years of age, you may use our Services only with the consent of a parent or legal guardian who agrees to be bound by these Terms. By using our Services, you represent and warrant that you meet these eligibility requirements.

2. Account and Authentication

To use certain features of our Services, you must create an account using a valid email address. We use passwordless authentication — you will receive a one-time code or link via email each time you sign in.

You are responsible for:

  • Maintaining access to the email address associated with your account
  • All activity that occurs under your account
  • Notifying us immediately at security@bawte.com if you suspect unauthorized access to your account

3. Product Registration

3.1 How It Works

Bawte allows you to register consumer products by scanning QR codes provided by participating brands. When you register a product, the information you provide (and certain automatically collected information as described in our Privacy Policy) is shared with the brand that manufactures the product.

3.2 Accuracy of Information

You agree to provide accurate and complete information when registering products. You represent that you are the purchaser or authorized recipient of any product you register. Registering products you do not own or providing false information may result in account suspension.

3.3 One Registration Per Product

Each product may only be registered once. If a product has already been registered by another user, you will not be able to register it again.

4. Warranties

Bawte is a technology platform that helps you record and track product warranties. Bawte does not provide, extend, or administer warranties.

  • All warranties are provided solely by the product manufacturer (the “brand”).
  • Warranty terms, coverage, duration, and claims processes are determined by the brand, not by Bawte.
  • Warranty extension incentives offered through our platform are provided by the brand and are subject to the brand's terms.
  • Bawte is not responsible for any brand's failure to honor a warranty or incentive.

By registering a product, you acknowledge that Bawte acts solely as an intermediary to facilitate the connection between you and the brand.

5. Incentives and Rewards

Some brands offer incentives for product registration, such as warranty extensions, coupons, discounts, cashback, or gifts. These incentives are:

  • Provided and fulfilled by the brand, not by Bawte
  • Subject to the brand's terms, conditions, and availability
  • Non-transferable unless the brand states otherwise
  • Subject to change or discontinuation at the brand's discretion

Bawte does not guarantee the availability, value, or fulfillment of any brand incentive. If you have questions about an incentive, contact the brand directly.

6. Receipt Uploads

You may upload a photo of your purchase receipt to support warranty claims. By uploading a receipt, you represent that:

  • The receipt is genuine and unaltered
  • You have the right to share the receipt
  • The receipt does not contain sensitive information beyond the purchase transaction (such as full credit card numbers)

Receipts are stored securely and are accessible only to you and the brand whose product you registered. We accept image files only (JPEG, PNG, WebP, HEIC) up to 5 MB.

7. Acceptable Use

You agree not to:

  • Register products you do not own or have not purchased
  • Provide false, misleading, or fraudulent information
  • Create multiple accounts to circumvent limits or abuse incentives
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated tools (bots, scrapers) to interact with our Services without our written permission
  • Interfere with or disrupt the integrity or performance of our Services
  • Use our Services for any unlawful purpose

We reserve the right to suspend or terminate your account if you violate these Terms or engage in behavior that we reasonably determine to be harmful.

8. Intellectual Property

The Bawte name, logo, and all related marks, designs, and content are the property of Bawte, Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.

Brand names, logos, and product images displayed within our Services are the property of their respective owners and are displayed with permission.

9. Third-Party Services

Our Services may contain links to third-party websites, resources, or services (such as brand support pages, external manuals, or video content). We are not responsible for the content, privacy practices, or availability of any third-party services. Your use of third-party services is at your own risk.

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that our Services will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant the accuracy, completeness, or reliability of any information provided through our Services, including third-party enrichment data.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BAWTE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF (A) FIFTY DOLLARS ($50.00) OR (B) THE AMOUNTS YOU HAVE PAID TO BAWTE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bawte and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any information you provide through our Services.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal legal action, you agree to try to resolve any dispute with us informally by contacting us at legal@bawte.com. We will try to resolve the dispute within 60 days.

13.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, United States, without regard to its conflict of law provisions.

13.3 Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Polk County, Iowa. You consent to the personal jurisdiction of such courts.

14. Account Termination

You may stop using our Services at any time. To delete your account and associated data, contact us at privacy@bawte.com.

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, brands, or our business. Upon termination, your right to use the Services immediately ceases.

Brands will retain registration data that was already shared with them prior to your account deletion, as that data is maintained under the brand's own data management policies.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. If the changes are significant, we may also notify you by email. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.

16. General

  • Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bawte regarding your use of the Services.
  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
  • Assignment. You may not assign or transfer your rights under these Terms. We may assign our rights to any affiliate or successor.
